In catastrophic truck crashes that kill or catastrophically injury innocent people, the root cause of the tragedy is often not the momentary carelessness of a truck driver. Rather, the root cause is very often the systemic mismanagement by a company that puts behind the wheel of an 80,000 bomb a person who never should have been driving it. The driver may be a good guy who because inadequate training or experience, bad driving record, or physical incapacity was not well-fitted for the job. That can result in a claim for negligent entrustment.

A tractor-trailer pulled from the highway shoulder in front of an approaching SUV on I-95 in Jasper County, SC, just north of Savannah, about 9:30 PM Wednesday night, August 8, 2018. The impact killed Raymond Jackson, Jr., driver of the approaching vehicle, a 1999 Ford Expedition. This happened about 3 miles north of the Georgia-South Carolina line, between the Savannah River and Hardeeville.

A fiery crash on I-95 at Richmond Hill near Savannah in Chatham County on July 26th caused the wrongful death of a woman and sent her husband to a specialized burn unit in Augusta. It appears all too typical of other truck accident cases we have handled throughout Georgia, including those in the Savannah area and along I-95 and I-16.

Occasionally we see a report of a commercial vehicle crash in which the alleged cause of the wreck perfectly matches the company’s poor safety record. Today, a bus en route from Brooklyn, New York to Doraville in metro Atlanta, operated by Indianapolis-based Princess Tours, Inc., ran off a road in Virginia.  The bus driver, Qilong Xiao, 50, of Flushing, N.Y., was charged with reckless driving.  According to Virginia State Police spokeswoman, speed was believed to be a factor in the crash.

Tractor trailer drivers are required to exercise “extreme caution” in snow and ice, including getting off the road when necessary. Their employers are required to make sure they do exercise “extreme caution.” However, I seldom see many who take that seriously. That was driven home in Tuesday’s winter storm.

Handling tractor trailer accident cases on behalf of injured people and their families across Georgia, I often see reports in which I think, “there but for the grace of God” would be a catastrophe. This week there have been four news stories of metro Atlanta crashes involving  tractor trailers. I don’t know the causes at this time, but usual suspects include speed, space management, fatigue and distraction. There are other factors that can come into play but I will not speculate about them.

CW Transport, LLC is a four-truck garbage hauling company in metro Atlanta. Though small in size, it is large in vehicle maintenance and unsafe driving violations. That bad record culminated in an incident in which the transmission parts from a CW Transport truck flew off the truck, across the median of I-20 and through the windshield of a Chevy Blazer.

ABCO Transportation, Inc., a refrigerated freight haulder based in Dade City, Florida, has had for several years an unsatisfactory record of unsafe driving violations with the Federal Motor Carrier Safety Administration.
